Waiver of Liability, Rules and Safety Procedures

Release and Waiver Liability

This is a legal document between the client "the renter/the client" and "DREAMLAND RENTALS YYC INC." which affects your legal rights, so please read carefully.

The renter desires to rent from DREAMLAND RENTALS YYC INC., equipment to be used by the renter, his/her guests, invites or other individuals while in renters possession. Renter understands that use of soft play equipment and/or bouncy castle may, by its nature, cause injury or harm to renter, his/her guests, invites or other individuals if not properly used. 

The renter does hereby freely, voluntarily, and without duress executes this release under the following terms:

  1. Waiver and Release: Renter understands and acknowledges that this release discharges DREAMLAND RENTALS YYC INC., from any liability or claim that the renter may have against DREAMLAND RENTALS YYC INC. with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the renters use and possession of DREAMLAND RENTALS YYC INC. equipment. 
  2. Insurance: Renter understands that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of the Renter.
  3. Indemnification: Renter/Client agrees that he/she will indemnify and hold DREAMLAND RENTALS YYC INC. harmless from any liability resulting from the use of DREAMLAND RENTALS YYC INC. by renter, his/hers assigns, heirs, guests, invites or other individuals utilizing the equipment while in renter's possession.
  4. Other: Renter expressly agrees that this release is intended to be as broad and inclusive as permitted by laws of the province of Alberta and that this release shall be governed and interpreted in accordance with the laws of the province of Alberta. Renter agrees that in the event that any clause or provisions of this release shall not otherwise affect the remaining provisions of this release, which shall continue to be enforceable.

SAFETY PROCEDURES/PLAY RULES:

  • Play at your own risk
  • Children must be supervised by an adult/parent/guardian (>18 yr old) while in the play area
  • NO shoes, sneakers, high heels, flip flops or sandals are allowed on mats (play area). They leave permanent marks on our equipment and will result in extra charges. 
  • Socks must be worn at all times 
  • NO food, drinks or sweets, gum or any sticky item allowed in play area
  • NO diving or throwing balls out of the ball pit. Balls must be collected and returned as it was set up before DREAMLAND RENTALS YYC’s team arrives to collect equipment or a minimum additional $25+ charge will be applied to client and we won’t be able to guarantee the completion of the pick up in the agreed upon time window. 
  • NO equipment should be removed from within the play area AND bouncy castle must NOT be deflated! (should be left as it was set up)
  • Uneven size difference of players in bouncy castle are ONLY permitted if rotated in different time frames 
  • No more than the recommended amount of players on one unit at a time (equipment dependent)
  • NO shoving, pushing, wrestling, piling or rough play in the play area
  • Soft play items are designed for younger children under approximately 10 years old and bouncy castles depend on the model (will be indicated on our website and catalog). 
  • Paint, stain & mess-prone items (i.e., glitter, slime, messy arty, temporary tattoos, face paint etc.) are NOT allowed and will result in extra cleaning fees starting from $50. Face paint is the worst, it may leave permanent marks which may result in needing to replace the equipment in which case the client is responsible for the full repair/replacement cost whether it was caused by face paint or any other paint/item that discolors! 
  • All sharp objects must be removed before play (including pens, pencils, jewelry etc.) If children wear health related accessories like eyeglasses, hearing aids etc. extra supervision is needed by the responsible adult. 

The Renter/Client Understands that:

  1. I am responsible for following the rules and safety procedures mentioned above by DREAMLAND RENTALS YYC INC.  in order to protect the equipment and provide a safe environment for me, my guests and any other individuals who will have access to the equipment(s) while it is in my possession.
  2. I am responsible for a 50% down payment at the time of booking. It can carry over to other events for up to a year in case the client needs to reschedule the party. However, it is non-refundable.
  3. The remaining 50% balance is due in full 48 hours prior to the day of your event along with the signed rental agreement and a copy of your driver’s license. Please note, our warehouse only releases play equipment to the delivery team if all of these conditions have been marked “confirmed”.
  4. I am responsible for providing access to DREAMLAND RENTALS YYC INC.’s delivery crew at the agreed upon time for both set up and take down. There will be a 15 minute grace period after which they will have to leave the premises if no access is granted OR contact has been made as they are on a strict time schedule with multiple deliveries a day! We kindly ask for your collaboration and understanding of this. 
  5. I will be charged a $150 damage deposit at the time of booking, which will be fully    returned to me after inspection on the day of the pick up, if no damages or cleanliness issues were claimed. *Clients who decide to pay with electronic transfer will be contacted regarding the appropriate damage deposit amount. 
  6. If the equipment is returned in an extremely dirty condition (face paint, food, shoes marks etc.) at the time of pick up I will be charged extra cleaning fees starting at $50+ depending on severity, which will be deducted from the damage deposit.
  7. If there is any damage found on the rental equipment whether caused by individuals, natural or unnatural disaster (tear/rip, broken pieces, permanent discoloration, hail damage or else) I will be charged at an appropriate amount, i.e. cost of repair or full cost of replacement!
  8. I understand that the items delivered to me have to be returned in the exact condition they were received. (food crumbs, grass and minor removable cleaning related items do not account for extra charge)
  9. I also acknowledge the risks involved in using DREAMLAND RENTALS YYC INC.’s equipment. These include but are not limited to any choking hazards, falling, breaking etc. while in use. I understand that I am participating voluntarily, and that all risks have been made clear to me.
  10. I acknowledge that all rental equipment provided by DREAMLAND RENTALS YYC INC. have been properly sanitized with exceptional care prior to each event minimizing the spread of any bacterial or viral infection and maximizing my own/child’s and guests’ safety.

By proceeding, I acknowledge and promise to obey the safety rules in efforts to keep my experience positive.
